Abstract:

آرای داوری تجاری بین­المللی، انواع متعددی دارد و دیوان داوری می­تواند آرای جداگانهای در خصوص موضوعات گوناگون صادر کند. در برخی قوانین تصریح شده است که دیوان اختیار دارد که انواع متعددی از رای را صادر کند. در قانون داوری تجاری بین­المللی ایران نیز بهطور تلویحی به انواع رای اشاره شده است. رای نهایی، جزئی و موقت، مهمترین آرایی است که تقریبا در تمامی اسناد بینالمللی بدان اشاره شده است. دسته دیگر آرای داوری مانند غیابی، اعلامی و تاسیسی ازجمله آرایی است که در هیچیک از قواعد و قوانین داوری، نصی به خود اختصاص نداده است. در حقوق ایران، برخلاف مقررات راجع به داوری داخلی، قانون داوری تجاری بینالمللی، حاوی مقررات مجزا و کاملی در خصوص تفسیر و تکمیل رای داوری است. در این مقاله، نویسندگان تلاش کردهاند تا هریک از انواع متعدد رای را مطالعه کرده و پیشنهادهایی جهت اصلاح قانون داوری تجاری بینالمللی ایران ارائه دهند.
