Abstract:
در کنوانسیون ژنوسید و اساسنامه دیوان بینالمللی کیفری، ارتکاب ژنوسید بهعنوان خطیرترین جنایت بینالمللی، علیه گروههای ملی، قومی، مذهبی و نژادی تعریف شده است. در زمان تصویب این اسناد ازجمله ایرادات وارده این بود که بهواسطه تمایلات سیاسی برخی دولتها، گروههای سیاسی از شمول تعریف ژنوسید خارج میمانند؛ حال آنکه تاریخ بشر، فزونی جنایات هولناک علیه گروههای سیاسی را گواهی میدهد. برخی صاحبنظران از دهه هشتم قرن بیستم به بعد تلاش کردند با ارائه نظریه ژنوسید سیاسی یا سیاسیکشی این نقص را جبران کنند. آنها با بهرهگیری از پویایی حقوق بینالملل کیفری، عناصر مادی و معنوی ژنوسید را بر این جنایت منطبق کردند و در نتیجه میتوان گفت اکنون محور اصلی چالش برای شناسایی قطعی این جنایت در حقوق بینالملل، رکن قانونی است. تفسیری غایتمحور از حقوق بینالملل کیفری و جرمانگاری ژنوسید، در نهایت به این نتیجه رهنمون میشود که شاید زمان بازنگری اسناد بینالمللی در این خصوص فرا رسیده است.
