Abstract:

حق انسان به زندگی در موطن و سرزمین اصلی خود، یکی از حقوق اساسی و اولیه انسان ها در طول تاریخ بوده است. اخراج و انتقال اجباری اشخاص از سرزمین مادری در طول تاریخ به وفور اتفاق افتاده است و آثار زیان بار آن هم اکنون نیز قابل مشاهده است. این عمل بنا به مقاصد گوناگونی ازجمله استثمار انسان ها و سلب حق مالکیت آن ها در سرزمین اصلی خود ارتکاب می­یافته است. با تاسیس دیوان بین المللی کیفری و صلاحیت این دیوان در رسیدگی به جنایات بین المللی، صراحتا انتقال اجباری اشخاص نیز به عنوان یکی از صور جنایات بین المللی، مشخصا جنایت علیه بشریت و جنایت جنگی شناسایی شد که در مقاله حاضر به بررسی ابعاد این پدیده به عنوان جنایت علیه بشریت و جنایت جنگی، و تمایز آن با مفاهیم مشابه از قبیل تبعید، نسل زدایی و رابطه آن دو، و در پایان با رویکردی انتقادی در قبال رویه قضایی دیوان بین المللی دادگستری در بررسی موارد انتقال اجباری اشخاص در قضیه بوسنی علیه صربستان و مونته­نگرو در ۲۰۰۷، به عدم رویکرد واحد بین دادگاه بین الملل کیفری یوگسلاوی سابق و رواندا و همچنین دیوان بین الملل کیفری پرداخته شده است.
