Abstract:

The right to health can be categorized as one of the basic and fundamental human rights which has been discussed in different international instruments through the time. By identifying the fact that considering this right in critical situations like imprisonment and special group of vulnerable people such as women is a very important topic, therefore the present research discusses about the principles which can be derived in the context of women prisoner right to health. Among international documents specifically recalling rights of women prisoners, Bangkok Rules as a Resolution adopted by the General Assembly on ۲۱ December ۲۰۱۰ contains significant rules and principles about right to health. Based on the importance of comparing these principles in national and international level the following research discusses about this comparison with present Iranian criminal procedure about the mentioned matter. The results although shows similarities and gaps between the international document and national criminal procedure which needs to be more adopted.
