خلاصه مقاله:
The aim of the present study is to examine accelerated arbitration in response to the time and cost of traditional international arbitration. International arbitration, as a method for resolving and adjudicating international commercial disputes, has faced challenges in recent years, particularly concerning the duration and cost of the process. These challenges, especially in complex and voluminous disputes, can lead to dissatisfaction of the disputing parties and a reduced attractiveness of arbitration as an alternative method for dispute resolution. In response to these challenges, international arbitration institutions, such as the International Chamber of Commerce (ICC), have in recent years formulated regulations and procedures for accelerated arbitration. Accelerated arbitration is an arbitration method designed with the goal of reducing the duration and cost of arbitration. This method typically involves time constraints for addressing disputes, a reduction in the number of hearing sessions, and a decrease in the number of documents required for submission to arbitrators. Accelerated arbitration can offer various advantages for the disputing parties. This approach may lead to a reduction in the time taken to resolve the dispute and, consequently, a decrease in arbitration costs. Additionally, accelerated arbitration can assist the disputing parties in swiftly and effectively resolving their differences with lower expenses.
