Examining the role of non-payment or delay in the payment of rent on the right of business and trade

Business is one of the most important parts of every person's life and it guarantees the future and provides the daily livelihood of every person. Business has rules that have an important place in different legal systems. In this research, the right to business, profession and trade is evaluated and for this purpose analysis is done using descriptive analytical method and using information collected from official legal sources. It should be noted that the Landlord and Tenant Relations Law of ۱۳۵۶ is exclusively dedicated to the laws related to the right to acquire, profession or trade, and in the Law of Landlord and Tenant Relations of ۱۳۷۶, which governs the current contracts, the legislator deals with the issue of the right to acquire And the profession has distanced itself and only recognized the right to goodwill, that too with the fulfillment of conditions. According to the law of ۱۳۷۶, when the owner leases his commercial property, he can receive an amount as goodwill from the tenant. In general, it can be said that the legislator made a difference between a tenant who refuses to pay the rent due to an accident, mistake or forgetfulness, and a tenant who intends to harass the landlord by this act and is persistent and deliberate in his work. He has predicted two different solutions, one of which is combined with friendship and the other is mixed with oppression and severity of action.
