Abstract:

در بررسی حوادث تروریستی و توجه به حقوق زنان بزه دیده، با نقض گسترده و روزافزون حقوق بنیادین و تثبیت شده آن ها مواجه هستیم. درحالی که حل مشکلات آن ها مهم ترین بخش اقدامات ضدتروریستی است اما نه تنها این معضلات رفع نشدهاست، بلکه زنان قربانی، دچار ظلم مضاعف هم می شوند. بر همین اساس سوال اصلی تحقیق حاضر این است چرا در جهان امروز باوجود انجام برخی اقدامات حقوقی در سطح بین الملل، اهتمام لازم در رفع عوارض مستقیم و غیرمستقیم ترور در مورد زنان و برقراری حقوق بنیادین آن ها مشاهده نمی شود چرا هرسال با رشد چشمگیر این گونه خشونت ها مواجه هستیم در پاسخ به پرسش بالا، این نوشتار با استفاده از روش کتابخانه ای (توصیفی- تحلیلی)، ضمن بررسی قواعد ماهوی درصدد کشف نقاط ضعف و قوت حقوق بین الملل برآمده است. براساس نتیجه حاصل از این پژوهش، نظم حقوقی مناسب برای حمایت و تامین حقوق زنان که در ماده 28 اعلامیه جهانی حقوق بشر بر آن تاکید شده، فراهم نشده است؛ بنابراین تقویت بنیانی ترین نهاد جامعه بشری یعنی خانواده اولویت اول حقوق زنان است. هم زمان نیز بایستی ساختارهای ملی و بین المللی متناسب با آن متحول گردد. در این جستار پس از تبیین حقوق تضییع شده زنان قربانی ترور در حقوق بین الملل، به نقش محوری نظم بین المللی و اجتماعی لازم برای تحقق آن اشاره شدهاست.
