Abstract:
Background and Aim : Remarkably, complaint are filed against the physician due to Negligence related to treatment of addiction people Negligence in the legal view, means person does not perform assigned task that the legislator has placed on that person. The legislator in the Islamic Penal Code, adopted in 1392, Defines negligence as omission or carelessness and also includes lack of skill and non-compliance with state regulations as part of this. Non observance to comply with government regulations: Do not pay attention to regulations, Ministry of Health, departmental letters, regulations of administrative superiors and medical system Eg: Office do not have naloxone to reverse patient who swallow a large amount of Methadone syrup carelessness : Performance of an action which scientifically and technically should not be done. eg: Prescribing Methadone for a patient who has elevated AST more than5 times above normally Omission: Non performance of an act which technically and scientifically is expected to be done. eg: Do not check of ALT at the beginning of treatment of patient who wanted to receive Methadone Lack of skill: Includes cases in which the physician does not have the scientific and technical skill necessary for a defined work. eg: Inappropriate administration of Methadone for patient that lead to apnea It is hoped that compliants against medical staff will be decreased by complying with legal requirements
