Abstract:
Given that there are many criminal cases in the revolutionary courts and judicial authorities today on the subject of insulting the sacred, it is necessary to carefully examine this issue. Unfortunately, the rules written in this regard are not clear and unambiguous as it deserves and the word sacredness of religion and the title of insult to religious sanctity are subject to various interpretations and possibly misuse. And this makes it impossible for judges and law enforcers to analyze the intentions of the accused and make fair judgments. Therefore, in this article, an attempt has been made to investigate the secondary prevention of insults to religious sanctities. The results of this study suggest that the crime of insulting sacred things may be committed under factors outside the behavior of defendants such as the legislature, the prosecutor s office and the police, and the legislature must be cautious in defining this crime and make the most of it to prevent this crime from happening. Various strategies have been used over time to prevent recurrence of crime. Prevention has not been successful through aggravation of punishment and over time, its inefficiencies have become apparent. As a result, the criminal justice system began to reform and heal.
