Abstract:
Military courts are among the exclusive authorities. The special authorities have no jurisdiction to prosecute any crime except as expressly permitted by law. In fact, the jurisdiction of special courts is limited and prescribed, and beyond the scope of the text, they do not have jurisdiction over crimes. However, the jurisdiction of the military courts went beyond the jurisdiction set out in the constitution and increased to the trial of some public crimes.By granting additional powers, military courts were allowed to deal with in-service and other security offenses. In this regard, it needs to be reviewed and corrected. In this article a Review of the Jurisdiction of Military Courts in the Code of Judicial Procedure of the Armed Forces has been studied.
