Religious Leaders’ Views of the Judgment of Women in Islam

Judges made by women and addressing their ability in order to attain the judgeship in Islam given the status of women in Islam and the value and dignity of women in Islam and community needs is and will be one of the important judicial debates of our today and our tomorrows. Thus, removing the serious and burdensome legal responsibility from the women’s shoulder doesn’t mean their failure in judging, because in most cases Islam has removed the hard burden out of the women’s shoulder; but this issue is not simply in the context of negation of the subjectivism, because studying the verses and traditions and opinions of pros and cons in relation to women’s judgments shows that this issue is not among those mysterious and devotional ones that make us obliged to obey and follow the comments of opponents because resorting to the reason one is able to find out that women’s capabilities simulated with those of men’s is an inherent issue.Due to the necessity of dynamic nature of jurisprudence compared to time requirements and given the value and status of women in Islam, necessity of revision in some rights for women specially the rights that there is no clear wording for lack of permit to it in Koran and narratives and other reasons are incomplete and ambiguous, and taking the presence of qualified and competent women with the utmost of modesty and veil that have caught up with men and even sometimes have taken precedence over them and also due to the attack targets of foreign countries in relation to discrimination against women that are sometimes quoted in western parliaments and human rights organization, this issue and its revision is keenly felt.
