Abstract:

One of the important debates that have been raised in today's societies, despite the fact that the conventions of international societies and laws and regulations and jurisprudence books that are inferred from the Qur'an and hadiths have addressed it, but there is still a place for discussion is the rulings of small and non-discretionary transactions. The purpose of this article is to examine the issue of whether children have the right to buy, sell and trade, if so, what is the ruling on these transactions? In this regard, by using jurisprudential sources and researching and searching in the laws and regulations, it explains the rulings of minor and non-discretionary transactions from different aspects of the contract and their effects. The research method in this article is descriptive, analytical, and library. As a result, it can be stated that the effect of child transactions in terms of jurisprudence and law and its application in different situations in international contracts and conventions which have been comprehensively and fully stated and in a way prevent the harm caused to children as well as the parties to the transaction. It is also examined in the framework of verses and traditions and civil law.
