Abstract:
در بحث قضا و شهادت برای قاضی و شاهد، شروط و خصوصیاتی بیان می‌شود که ازجمله این شروط، شرط حلال‌زادگی است. بررسی کتاب‌های فقهی متقدمان نشان می‌دهد زنازاده نبودن در شهادت شرط است. این در حالی است که در میان متأخران، طهارت مولد به عنوان شرط مطرح شده است. با توجه به اینکه این اختلاف منشأ اثر فقهی است و دربارة فرد مجهول‌الحال ـ طبق مبنای قدما ـ مانعی از شهادت وجود ندارد؛ ولی طبق مبنای دیگر احراز طهارت مولد شرط است. نوشتار حاضر با بررسی روایات و دیگر ادلة مطرح‌شده در لسان فقها، این مسئله را بررسی می‌کند. حاصل پژوهش نشان می‌دهد با لحاظ روایات صحیحه در مسئلة شهادت، دیدگاهی که زنازاده نبودن را شرط می‌داند، اقوی است؛ اما در مسئلة قضاوت به دلیل نبودن ادلة کافی، حتی اثبات زنازاده نبودن نیز محل اشکال است.
