Solution to Combating the Financing of Terrorism (CTF)in the European Court of Human Rights abstract
Combating the financing terrorism is one of solution for combating terrorism. Hence, countries have themselves, directly or through the United Nations, prepared documents and regulations to block terrorist financing. In terms of their importance and formal validity and binding character, Security Council resolutions, in particular Resolution 1373 adopted, are of paramount importance; Secondly, the International Convention for the Suppression of the Financing of Terrorism (1999), drafted by the United Nations; and there are the IX Special Recommendations as well as some related forty recommendations from the Financial Action Task Force. Although the recommendations of the Financial Action Task Force, contrary to Resolution 1374, are not supported by Article 25 of the Charter of the United Nations, Indeed, they are of practical importance. The contents of these documents are arranged in such a way that each document is complementary and in some cases a duplicate. In accordance with Article 25 of the Charter of the United Nations, the implementation of Resolution 1373 is mandatory; On the other hand, this resolution calls on the member states of the United Nations to join the International Convention for Combating of Financing Terrorism. This article aims to answer the question that: What are the most important strategies to combat the financing of terrorism in the European Court of Human Rights, and what mechanisms does the international community envisioned to combat them? The Library research method is used in this article, due to its library nature, it differs from the other work in this area, examines the strategies for combating the financing of terrorism in the European court of human rights. Whereas other research has been conducted on the issue of terrorism and the place of this phenomena in the rise of international crime; So, this is a whole new article.
