Abstract:

All of us are well familiar with this legal phrase, along with any content production and creation of works, that: all the material and intellectual rights of the work belong to its creator and no one has the right to reproduce and publish this work without the permission of the owner of the work. If it is violated, it can be criminally prosecuted; From this point of view, in the following article, we decided to deal with this fundamental concern and question with a descriptive-analytical statement that, when we clearly know that in modern intellectual property in the field of customary law, the exclusive right of the original invention and how to use it belongs to the creator, and this is considered a legal doctrine, why in the universe of creation and the totality of existence, such a right with the support of Muslim intellectuals; Shouldn't we consider the ownership of the work exclusive to the owner?! The author's hypothesis and claim in this article is that in the third age of psychology, mankind will first recognize this unencumbered right and then make it flow in the realm of human quality of life. God's word as the creator and owner without a partner in this category is as follows: We created man and we know what he thinks inside himself and we are closer to him than his heart. God is the only one who knows the intentions and secrets of the breasts. Does not the God who created the creation know their secrets? While he is aware of the inner and outer aspects of all the affairs of the world. (Several verses from the Quran). The result of the research showed that neglecting the creator of the totality of human existence (found and hidden) reduces the quality of life and hope for the future and makes life painful and mechanical. The hidden and spiritual experiences of man, along with material well-being, can bring mankind to the peak of happiness, which is his essential and essential need, and as a result, the right of the creator's creativity and the creation of the creature will be given to its rightful owner.
