Analyzing the general and specific conditions for the implementation of the investigation of the crime of aggressive possession documented in the Law of Penalties and Deterrent Punishments approved in 1375

One of the few issues that can be dealt with both legally and criminally is aggressive possession. This same legal and criminal proceedings will be the reason for comparison and duality in criminal proceedings. Some jurists, referring to the civil procedure law, consider the prior possession of the plaintiff and the right of possession of the defendant and its aggressiveness as criteria for proceedings in the criminal court, and some others consider the conditions of proceedings in the criminal court to be separate from the aforementioned cases. The author has written this article by examining various library sources and with the aim of explaining the conditions of proceedings in the criminal court. The innovation in this article is that we divide the conditions of proceedings in the criminal court into two general and specific categories and examine the nature of each separately
