Abstract:
In Iranian law, based on articles 495 and 496 of the Islamic Penal Code, the principle is based on the assumption of the doctor's fault in treating the patient. This statement means that in the event of any injury or damage that causes harm to the patient, the doctor must prove the correctness of the type of treatment, perform medical technical standards during the treatment and ensure that the person or deputy before performing, Has received the necessary permission. It frees the doctor from civil and criminal liability.
In laparoscopic surgery, which is a category of minimally invasive treatments, compared to other surgical methods, it has advantages such as less pain and bleeding and faster recovery time for the patient. If a doctor fails to meet professional standards during the treatment process or makes a mistake that leads to infection, bleeding, or damage to the abdominal organs, he or she can be held liable, depending on the type of defect and the extent of the damage
