The Role of Empirical Evidence in Strengthening Human Rights: A Utilitarian Approach in Public Law abstract

This study aims to examine the role of empirical evidence in strengthening human rights from the perspective of utilitarianism and legal positivism. Through the analysis of empirical data, the impact of respecting human rights on collective welfare and social progress has been evaluated. The results indicate that governments' adherence to human rights not only reduces suffering and enhances citizens' well-being but also positively correlates with quality of life indicators and social development. Based on utilitarian principles, respecting human rights is justified as a means to maximize public happiness. From a commonsense perspective, after reviewing statistics and research, it is evident that governments' respect for human rights leads to improved civil conditions and social welfare. These findings emphasize the necessity of incorporating empirical evidence in the formulation and implementation of legal policies.
