A Comparative Study of the Role of Administrative Courts in Ensuring the Functions of the Administrative Council in the Iranian and German Legal Systems

Administrative councils play a significant role in implementing the decisions and instructions of the upper echelons in each of the three branches. In general, administrative councils should operate under the executive branch of each country, which is generally the case in the Iranian legal system, and therefore, administrative councils in the Iranian legal system should be considered as executive councils. In the German legal system, however, administrative councils are general councils that are allowed to operate in each of the three branches. The question posed in this research; That is, according to the procedure of administrative courts in the legal systems of Iran and Germany, what is the difference between the functions of administrative councils? The result of the present study is that in terms of principles and objectives, according to the procedure of administrative courts, the functions of administrative councils in the legal system of Iran and Germany are different from each other.
