In modern sport, referees are more than rule enforcers — they are guardians of fairness and safety. But an important legal question remains:
Can referees be held legally liable for their decisions?
From a legal perspective, liability arises only in exceptional situations. Ordinary human error is part of the game and generally protected. However, gross negligence, clear disregard for safety regulations, or intentional misconduct may trigger civil, disciplinary, or even criminal responsibility.
Sports regulations and federation rules define the standard of care expected from referees and provide mechanisms of accountability. At the same time, the law must protect referees from excessive legal exposure, as fear of liability could undermine the very nature of competitive sport.
📌 Modern sports law therefore adopts a balanced approach:
Referees are protected decision-makers, but not immune where there is serious fault or bad faith.
In the era of VAR and public scrutiny, the legal status of referees is no longer marginal — it is a core element of sports justice.
🔹 داور زیر ذره بین قانون؛ قدرت یا مسئولیت؟
در ورزش مدرن، داور تنها مجری قوانین نیست؛ بلکه نگهبان عدالت و ایمنی رقابت است. اما یک پرسش اساسی مطرح است:
آیا داور در قبال تصمیمات خود مسئولیت حقوقی دارد؟
در حقوق ورزشی، خطای انسانی عادی پذیرفته شده است و مسئولیتی ایجاد نمی کند. اما در صورت تقصیر فاحش، بی توجهی به ایمنی یا سوءنیت، امکان طرح مسئولیت مدنی، انتظامی یا حتی کیفری وجود دارد.
مقررات فدراسیون ها استاندارد رفتار و حدود وظایف داور را تعیین می کنند، اما در عین حال باید از او در برابر مسئولیت های افراطی نیز حمایت شود؛ زیرا ترس از مسئولیت می تواند ماهیت رقابت ورزشی را مختل کند.
📌 بنابراین، رویکرد حقوق ورزشی ایجاد تعادل است:
داور تصمیم گیرنده ای حمایت شده است، اما در برابر تقصیر جدی مصونیت ندارد.
در عصر VAR و نظارت گسترده رسانه ای، جایگاه حقوقی داور به یکی از ارکان عدالت ورزشی تبدیل شده است.
