Abstract:

Basically, criminal psychology is the science of studying the personality of criminals as well as their resocialization methods and examining the role of the environment (in a general sense) on criminal behavior. Due to the importance of the subject, the current research has been written in the form of analytical-descriptive research methodology with the aim of investigating the reflection of the thoughts of crime and criminal psychology on criminal behavior in judicial procedure. The findings extracted from this picture, which was drawn based on the research of library studies, indicate that in the framework of the judicial processes and the issuance of sentences in the current era, we need competent judicial authorities to examine the roots of the psychology of crime when examining judicial cases with Follow more deeply. Because this category is a very important element to the extent that it can sometimes lead the way of the case and proceedings towards more realistic handling and more justice in the judicial system. It may be that in recent years, a relatively reflection of criminological approaches centered on the psychology of crime has been noticeable in the judicial dictionary of the country, but it is not enough. So, it can be concluded that psychological factors have a great impact on the commission of a crime, and this causes the connection of criminal law with the science of criminal or criminal psychology. It should be said that the most important thing that is evident in the study of the criminal personality of people is the wrong beliefs that are hidden in the institution of the criminal person, which causes him to find a desire to commit a crime based on the pleasure-seeking and desires that are derived from his institution, and the motivations that are materially Draw for yourself and bring it to the emergence stage. In fact, a repeat offender examines everything based on his personal criteria and does not include other people in his calculations. His moral standard is his own and it is he who gave legitimacy to the criminal act, while the judgment of others or the law are not included in his considerations.
