Abstract:

Recent advancements in artificial intelligence (AI) have brought new opportunities to human society. However, these advancements have also introduced new risks and challenges. One of these challenges is the rise in crimes related to AI. As the use of new technologies expands, identifying and combating emerging crimes has become particularly important. The criminalization of these crimes is essential to protect individual rights, maintain community security, and prevent the spread of illegal activities in cyberspace. Failure to criminalize these crimes can lead to their increase and cause serious harm to society. AI-related emerging crimes are those associated with new technology, arising from its use, such as phishing, pharming, internet gambling, and internet fraud. The novelty and emergence of this technology and the crimes committed in this field imply that some of these crimes are not yet reflected in the legislature's thoughts and thus have not been criminalized. This research, conducted through a descriptive-analytical method, seeks to examine the possibility of criminalizing crimes committed using AI. The findings of the research indicate that, considering the crimes committed through AI, it is possible to argue for the criminalization of these types of crimes based on various principles. In other words, according to principles such as the no-harm principle, public interest, and others, it is possible to advocate for the criminalization of emerging crimes.
