Abstract:

The efficacy of municipal regulatory frameworks is central to achieving sustainable urban development. In the context of Urmia, Iran, the implementation of Article ۱۰۰ of the Municipal Law—intended as a deterrent against unauthorized construction—has faced critical challenges, often devolving into a revenue-generating mechanism that undermines urban order. This paper investigates the urgent necessity of reforming Article ۱۰۰ to align municipal governance with the principles of sustainable urbanism. Through a critical analysis of current enforcement patterns, the study identifies a growing disconnect between regulatory compliance and the preservation of Urmia's architectural identity, spatial equity, and environmental resilience. The findings suggest that the current penalty-centric approach fosters an economy of violations, which exacerbates urban sprawl and diminishes social trust in local governance. To mitigate these effects, the research proposes a transformative reform framework characterized by a shift from reactive fine-collection to proactive, technology-driven urban management. Key recommendations include the integration of Smart City monitoring systems, the implementation of transparent judicial processes in municipal commissions, and the transition toward value-added urban economics. Ultimately, this study argues that reforming Article ۱۰۰ is not merely a legal necessity but a fundamental prerequisite for securing Urmia's long-term sustainability and ensuring the equitable distribution of urban resources for future generations.
