اثر سطوح حمایت از حقوق مالکیت فکری بر انتقال فناوری و توسعه اقتصادی abstract

نظام حقوق مالکیت معنوی برای پدید آورندگان آثار فکری دو گونه حقوق مادی و معنوی به رسمیت شناخته است. هر دواین حقوق به منظور حمایت از دانش و پیشرفت جامعه وتوسعه پایدار همه جانبه و منافع پدید آورنده به وجود آمده و در دیدی عمیقتر و آیندهنگری بیشتر نقشی فراگیر در بسط حقوق بشر و افزایش رفاه نوع بشر داردبر همین اساس در اسناد کنوانسیون سازمان ملل درخصوص مبارزه با بیابانزایی، معاهد « ، مختلف حقوقی بین المللی مانند معاهده منشور انرژی مادرید وکنواسیون تریپس ، بر نقش و ضرورت حمایت از مالکیتهای فکری در توسعه اقتصادی و اجتماعی تأکید شده است اما حقوق دانان و اقتصادانان در تحلیل اثر سطوح حمایتی از داراییهای فکری بر روند انتقال فناوری دیدگاه مختلف دارند . به عقیده برخی تدوین و اجرای استانداردهای بالا در حمایت از دارائیهای فکری تأثیری بر جریان انتقال فناوری و توسعه تکنولوژیک نداشته و سطح تجاریسازی ابداعات را کاهش میدهد ولی در تقابل با این اندیشه برخی حمایت حداقلی از مالکیت فکری را مانع نوآوری های و توسعه اقتصادی و اجتماعی می داند. نقد و بررسی ادله دیدگاه های مزبور نشان می دهد که بهترین گزینه در برقراری تعامل مطلوب میان نظامهای مالکیت فکری و انتقال فناوری، اتخاذ سیاست حمایتی میانه است، به نحوی که منافع طرفین انتقال فناوری را برآورده سازد
