A Comparative Study of Fundamental Human Rights in Iran and International Documents

The fundamental human rights are among the rights, which in comparison with other human rights’ regulations are more brilliant, irreversible, and un-deviational, and their lack of observance would lead to the international responsibility of all governments. Although in the Islamic revolution system of Iran, these rights do not have equal values, they are interdependent. The fundamental rights such as living right, freedom, prohibition of torture are emphasized and supported both in the Islamic republic of Iran ( chapter 3) and the international documents ( universal declaration of human rights and Conventions). However, in some regulations such as the type and punishment of criminals and equality of people against the law, there are discrepancies between Iran’s regulations and the international documents which due to compliance of the Iranian regulations of the Islamic and sharia standards and its compliance with the standards of the international rights has led to challenges, so the international community’s of the international rights have condemned Iran for violating such rights. In this research, which is a descriptive- analytic one using library and the internet, it has been attempted to analyze the foundations and the essence of the human rights and the fundamental human rights and meanwhile, find a solution for the difference between these rights. Moreover, looking briefly at the human rights’ system in Iran, the similarities and differences between these rights in Iran and the international rights are introduced. Finally, the issue of violation of the fundamental human rights and the commitments considered for these rights in the domestic and international courts are analyzed.
