The legal and criminology analysis of strife law with smuggling weapon and ammunitions

Abnormal phenomenon of smuggling is an inhibitive factor and complicated problem and multidimensional that its origins are concealed in national, regional, and international field. Firearm production and smuggling not only pays organized criminal groups illegal large benefits, but also these groups and other criminal ones especially terrorists as well as criminal people support has a major role. Inner legislative helping this topic undertakes approving criminal law of weapon and ammunitions smuggling and unauthorized owners of weapon and ammunitions in 1390. Although this law fills existing legal gap in mentioned crime field, it has some shortcomings especially in prevention field of weapon and ammunitions smuggling crime occurrence. Although legislator in article 19 of this law has emphasized the issue of this crime prevention, Iranian legislator strategy has sever punishments in this field for committers of weapon and ammunitions smuggling crime without considering practical strategies of preventing this crime occurrence seems to deserves criticizing
