The independence of the judiciary in the legal system of Iraq and Iran abstract

The purpose of this article is to investigate the legitimacy of power and its effect on the observance of citizen's rights. The legitimacy of political power is one of the main concerns of governments. In the legal system of the Islamic Republic of Iran, the issue of the legitimacy of power is one of the basic necessities of the country's legal system. Therefore, special attention has been paid to this issue. The main question of the research is that, in the system of the Islamic Republic of Iran, how is the legitimacy of power carried out and what effect does this legitimacy have on the observance of citizen's rights? The main hypothesis of the article is that, in order to legitimize the power, various components must be assembled to witness the legitimacy of the power, which will guarantee and respect the rights of citizens. The results of the research show that, by strengthening the components of political legitimacy and in order to maintain the stability and durability of the political system, in addition to the foundations of legitimacy related to the time of its establishment, its stabilizing and continuing factors should also be taken into consideration in order to strengthen the legitimacy of the power of the political system. , obtained more accurate criteria to evaluate its performance. But in order to know the legitimacy of political power, some elements must be strengthened in order to witness the legitimacy, which will ultimately lead to the observance and guarantee of citizen's rights. The method of the current research is descriptive-analytical, which has been used to collect information through the study of documentary and library sources.
