Abstract:

نانوفناوری نظامی، یکی از انواع حضور فناوری های نو در فضای مخاصمات مسلحانه تلقی می شود. اگرچه فلسفه اولیه توسعه نانوفناوری در صنایع نظامی برای استفاده در نبردهای شهری تنظیم شده بود، با تاثیر فزاینده آن بر تمامی جنبه های علوم و صنایع نظامی، اینک در تمامی انواع مخاصمات مسلحانه به کار می رود. بدون شک، این توسعه کاربرد نانوفناوری نظامی در سالیان گذشته، موجب تلفات عمده غیرنظامیان و اهداف غیر نظامی شده است به گونه ای که رعایت قواعد بین المللی بشردوستانه را اجتناب ناپذیر می کند. بااین حال، چالش ها و خلاهای عمده ای مطرح است مانند اینکه چگونه می توان اصول مسلم حقوق بین الملل بشردوستانه را با استفاده از نانوفناوری نظامی در صحنه مخاصماتی تطبیق داد؟ یا اینکه آیا هم اکنون قواعدی در حقوق بین الملل، برای محدود کردن کاربرد نانوفناوری نظامی وجود دارد؟ نتیجه تحقیق حاضر بدین صورت است که اگرچه اینک معاهده خاص بین المللی در زمینه کاربرد نانوفناوری نظامی در عرصه مخاصماتی وجود ندارد، از یک سو می توان با توسعه اصول حقوق بین الملل بشردوستانه، چون اصل عدم تفکیک میان رزمندگان و غیررزمندگان و اصول منع آسیب غیرضروری و منع آسیب به محیط زیست و از سوی دیگر، با اتکا به محدود سازی ارادی، کنترل پیشگیرانه و حقوق نرم به تنظیم کاربرد نانوفناوری نظامی در فضای مخاصماتی و به تبع آن، احترام بیشتر دولت ها به اصول حقوق بین الملل بشردوستانه در فضای مخاصماتی پرداخت.
