Abstract:
Leveraging or in modern interpretation is one of manifestations of administrative corruption which has an history as long as human society and has direct relationship with political and economic system development of societies. This research has been arranged using documentary style and descriptive-analytical method and aims at jurisprudence studying of leveraging against legal laws and regulations, explaining the respect of this subject and effect of this illegitimate action in society in economic, social and judicial dimensions having referred to book, tradition and some judgments made by contemporary jurists of Shia, Sunni and common sense. Therefore, this research concludes that getting any amount via leveraging against legal rights and regulations is doctrine of unjust enrichment according to mentioned aspects and is considered as examples of Soht (illegitimate property). The result of this research is demystifying and expressing different dimensions of social, judicial and administrative justice.
