Checking difficulties between citizens acquired rights with public interest in urban and rural plans In Iran's right system with review on Frances rights

In every society, citizen has some rights about own society and he/ she should undertake some duties about it. Having pure environment for healthy life’s and possession rights are essential rights for social life area. Today, these rights are faced with some serious risks, because some difficulties threat these rights including irregular city growth and some bio environmental will be threated such as industrial contaminations that go to rural frontage. According to them, to solve these significance problems that accompany with increasing urban population and changing rural area to urban pace, professor who study related sciences be forced to find some plans to develop and grow urban areas and protect rural life environment in some aspects such as cultural, biology, social, recreation aspects and short range plan and long range plan, Guidance projects, detailed project and comprehensive project are included in planning and they are evidence in planning. These plans try to predict all of phases and aspects of urban and rural development with whole details and some institutes are determined to perform them. In execution of these plans, acquired rights and personal property are threated. In other words, performing mentioned plans cus as that some intricate and difficulties are arisen between personal property and public interest. In one hand, dominant rule and public interest are met. Citizen relationship need to pay attention to interest and social expedients and citizen relationship limits some rules such us dominant rule and it is taken as citizen individual rights. In this time it is tried to make clear that in which cases, properties should be respected and in which cases public interest should be more preferable than individual interest.In this paper, we use library method and we alsouse long time expreince about participate in make decision in rural and urban areas.
