A Comparative Contemplation on the New Approach of Administrative Health Promotion and Anti-Corruption Act of Iran toward Criminalization

Diversity and plurality of the crimes and inability of traditional punishments in controlling them forced the legislators to enact the Administrative Health Promotion and Anti-Corruption Act in order to deliver innovations to fight corruption. In this law, by providing new definitions of corruption, the Iranian legislators have under taken to enact punishments consistent and relevant with economic and financial punishments which are the basis of administrative corruption. In the mentioned law affected by United Nations Convention against Corruption, some manifestations of modern and preventive Criminal Policy are observed. In enactment of Administrative Health Promotion and Anti-Corruption Act using the Anti-corruption Convention, mere tendency to traditional and common punishments was avoided, the modern criminal policy was involved in enactment of laws and preventive and deterrent aspects of the laws have been considered rather than diversity or severity of the punishment for the first time. Finally, it must be noted that the efficiency of innovative and positive aspects of Administrative Health Promotion and Anti-Corruption Act depends on realization of the predicted installations, will of the policymakers and the executors.
